A trademark is a intellectual property consisting of recognizable sign, expression or design which identifies particular product or services from other. A trademark can be owned by a individual, business organization or  legal entity. A trademark can be located on package label or organization. Trademark is an intellectual property that is used to differentiate products and services of one firm or individual from others. A trademark is an unique identifier for a product or a firm. Owner of a trademark can pursue legal action for infringement of trademark.

What is trademark class?

Trademark is divided into 45 different trademark class according to NICE classification. NICE classification which was established under NICE agreement, 1957 is also known as International Certification of Goods and Services. These 45 trademark classes  are divided into goods and services category. There are 34 classes for goods category and 11 under services category. Trademark class search is one of the initial and most important steps in Trademark registration. There is a trademark class for more than 80000 products and services. Trademark class search should be done to identify trademark class under which product and service belongs. NICE/Trademark classification for Goods

  1. Class 1 – Chemicals used in science, industry, agriculture, horticulture, adhesives etc.
  2. Class 2 – Varnishes, paints, lacquers; preservatives against rust and against deterioration of wood etc.
  3. Class 3 – Cleaning and bleaching products such as soaps, essential oils, cosmetics etc. Products used in laundry.trademark class
  4. Class 4 – Industrial oils and greasing products which includes candles, fuels, wicks etc.
  5. Class 5 – Pharmaceuticals, veterinary products, dietetic, dental wax, disinfectants, herbicides, fungicides etc.
  6. Class 6 – Common metals and their alloys, metal building materials, cables and wires etc.
  7. Class 7 – Machines, Construction equipment, Generators of electricity, Conveyors and conveyors belts, Textile and leather sewing equipment.
  8. Class 8 – Hand tools and implements (hand-operated); cutlery; side arms; razors
  9. Class 9 – Computing and scientific equipment which includes surveying, electric, photographic, cinematographic, optical, weighing, measuring, signaling equipment.  Calculating machines, cash registers, data processing equipment are also included in this trademark class.
  10. Class 10 – Surgical, medical, dental and veterinary apparatus and instruments, artificial limbs, eyes and teeth; orthopedic articles; suture materials
  11. Class 11 –  Apparatus for  lighting, heating, steam generating, refrigerating and sanitary purposes.
  12. Class 12 – Vehicles; machines for locomotion by land, air or water
  13. Class 13 – Explosives, fireworks, firearms, ammunition and projectiles.
  14. Class 14 – Precious metals, stone, jewelry, alloys of precious metals, horological and other chronometric instruments
  15. Class 15 – Musical instruments and accessories used with musical instruments.
  16. Class 16 – Cardboard, paper, and goods made from these materials, print matter, bookbinding, paint brushes, playing cards, printing blocks etc.
  17. Class 17 – Rubber, gutta percha, gum, asbestos, mica and goods made from these materials and not included in other classes; plastics in extruded form for use in manufacture; packing, stopping and insulating materials; flexible pipes, not of metal
  18. Class 18 – Various leather goods , goods made from animal skin including travelling bags; umbrellas, parasols and walking sticks; whips, harness and saddlery
  19. Class 19 – Non metallic materials including building material, transportable material and monuments etc.
  20. Class 20 – Picture frames, mirrors, Furniture of wood, cork, reed, cane and not included in any other category.
  21. Class 21 – Household and kitchen utensils, brush making material, articles for cleaning purposes etc
  22. Class 22 – Ropes, string, nets, tents, awnings, tarpaulins, sails, sacks and bags (not included in other classes)
  23. Class 23 – Yarns and threads used in textiles.
  24. Class 24 – Textiles and textiles goods including bed and table covers. textiles goods not included in other trademark class.
  25. Class 25 – Clothing, footwear, and headgear.
  26. Class 26 –  Lace and embroidery, ribbons and braid; buttons, hooks and eyes, pins and needles; artificial flowers.
  27. Class 27 – Game and playthings, and other sporting items which are not covered under any other class. Christmas decorations.
  28. Class 28 – Games and sporting articles not included in other classes. Decoration for Christmas items is also included in this trademark class.Trademark class
  29. Class 29 – Foods: Dairy, Meat, Fish, Processed & Preserved Foods
  30. Class 30 – Coffee, tea, cocoa, sugar, rice, tapioca, sago, artificial coffee; flour and preparations made from cereals, bread, pastry and confectionery, ices; honey, treacle; yeast, baking powder; salt, mustard; vinegar, sauces, (condiments); spices; ice
  31. Class 31 – Agricultural, horticultural and forestry products and grains not included in other classes; live animals; fresh fruits and vegetables; seeds, natural plants and flowers; foodstuffs for animals, malt
  32. Class 32 – Aerated and non alcoholic drinks including juices.
  33. Class 33 – Alcoholic beverages except beer.
  34. Class 34 – Matches, smoker’s articles and tobacco

Services trademark class

  1. Class 35 – Advertising, business management,, office functions, business administration.
  2. Class 36 – Insurance, financial and real estate affairs
  3. Class 37 – Building construction; repair; installation services.
  4. Class 38 – Telecommunications
  5. Class 39 – Transportation and storage In this trademark class, any service related to storage of goods in a warehouse or any other place or transporting them from one place to another is included. The transportation can be via land, air or water.
  6. Class 40 – Services that are involved in changing chemical and mechanical composition of a substance.
  7. Class 41 – Services which improves education and mental ability of a individual or provides entertainment.
  8. Class 42 – This trademark class includes technological and scientific services provided by knowledge workers such as engineers and scientist.
  9. Class 43 – Services for providing food and drink; temporary accommodation.
  10. Class 44 – Medical services such as medical advices. It also includes the services which are related to the field of horticulture or agriculture but does not include the services which are already covered under classes 37, 39, 40, 41,42,43. It particularly includes the services of breeding of animals, services relating to plant growth, medical advice, services relating to artificial insemination.
  11. Class 45 – Personal and social services rendered by professionals to meet the needs of individuals and firms, Astrological and spiritual services, Dating services, Legal services
